Kristin Cavallari Cites ‘Marital Misconduct’ in Divorce with Husband Jay Cutler

Yesterday, the news broke that Very Cavallari star and The Hills alum Kristin Cavallari was filing for divorce from Jay Cutler, a former NFL player. To some fans, this announcement came out of nowhere. However, Kristin’s statement pulled a textbook, vague excuse that theyhad been “growing apart.” Just like most people in the public eye, the reality TV vet asked people to respect their privacy during this tough time.

Well, privacy is out the window, a mere 24 hours later. Now, the gloves are coming off, the accusations are flying, and the initial indication that this would be an amicable split could not seem any more misleading. Court papers, don’t lie, people! Most likely, it’s gonna get even messier before they are able to resolve this.

Once again, TMZ came through with some legal documents. Kristin claimed that Jay “is guilty of such inappropriate marital conduct as renders further cohabitation unsafe and improper.” She also jumped ahead of any claims that might be made that she is the one who misbehaved, writing “any misconduct alleged or implied against her in the complaint for divorce was in response to and/or as a result of misconduct on behalf of the Husband.” For the record, Jay never actually used the word “misconduct” when he filed for divorce.

Kristin is gunning for primary physical custody of their three kids, leaving Jay with visitation rights. In contrast, he wants joint custody. She also slammed him with allegations that he’s an absentee father. Meanwhile, Jay insisted that he was “the available at-home parent and primary caretaker” for the children. These two also had a difference of opinion about the date of their separation. The Paradise Hotel host says they split on April 7. He claims they separated on April 21.

It looks like these two have started an intense battle of he said, she said. That initial claim of merely “growing apart” could not be further from the truth. The Hills drama has nothing on this situation and it’s only just the beginning. They’re not even officially divorced. And, most likely, given their drastic difference of opinion, that is not going to be a short and sweet process. If Very Cavallari returns for Season 4, it’s going to be a lot more interesting than previous seasons where the biggest source of drama was shipping out empty boxes to customers.
