TMZ, first reported that Ben had been arrested for drunk driving on March 15 at 12:21 am in Michigan. The details of Ben’s arrest were unclear, but there were records of his bond being set at $10,000. It was later revealed via an update that Ben’s “OUI and suspended license arrest was back in 2020.” In January 2021, he was sentenced to 18 months probation. He was taken into custody at the Oakland County Jail. Ben was released on bond on the same evening after spending over 18 hours in jail at 6:59 pm.

The publication claims Ben eventually pleaded guilty to a “lesser charge of OWAI (operating while ability impaired) and the suspended license charge was dismissed.” The publication also noted that it is unclear how he violated his probation. One day after his arrest, InTouch posted an article about how the father of four Ben also “ran into financial issues that led to several liens for delinquent taxes.” Ben has reported having several liens placed on his Warren, Michigan property over the years.

Fans recently also came across a shared Facebook profile of him and his ex named Amy Phung, who he’s not mentioned on the TLC show. Soon after Reddit discovered the account “Ben N Amy Rathbun-Phung” and rumors of Ben being married to the woman started spreading, he disappeared from Instagram. Along with Ben, even Mahogany deactivated her IG, and proof of them being still together was shared by a 90 Day Fiancé: Before the 90 Days viewer who spotted them in a Lima mall around February 24. Whether Ben had told Mahogany about his 2020 arrest or his money issues behind the cameras is not known.
