However, Rusty does not buy his excuses, pestering him until Kyle reveals he overheard conversations between him and Barbara and wanted to know who Rusty was having an affair with. Even when Kyle honestly tells him why he was there, Rusty only gets more mad at him.

Rusty claims that if he only wanted to see Carolyn’s face, he could just have googled her name. With what follows, he gets even more confrontational and asks him if he was casing out her house. Kyle responds by saying that he himself might not have had a reason to visit Carolyn’s place but was trying to figure out why Rusty visited her. This catches Rusty off-guard for a while, and he soon walks out of his house. Kyle later tells Barbara he only rode his bike around Carolyn’s house a few times out of sheer curiosity.

Raymond Reminds Rusty That He Lost The Right To Defend Himself A Long Time Ago

After his conflict with his family, Rusty finds himself arguing with Raymond the next day. Raymond, too, reminds him how he betrayed both his wife and children by having an affair with Carolyn. He gets sick of Rusty’s excuses and tells him that he can come up with every argument in the world to defend his actions, but that will only make the jury hate him even more. Rusty gets even more defensive and claims he feels both shame and guilt for what happened, even though Raymond does not believe him.

Raymond tells him that shame is self-centered, while guilt stems from one’s empathy towards how one’s actions affect others. He then tells Rusty that he does not feel shame for what he did. This completely shuts down Rusty, making him wonder whether he only feels bad about everything because he got caught.

When Molto later tells Guardia about this, he tells him he would need hard evidence to win the case instead of merely relying on character judgment.

Winslow Discourages Raymond From Putting Rusty On The Witness Chair

Winslow Realizes Rusty Can Come Off As An Unreliable Narrator

After talking to Rusty, Winslow realizes he was a little too drunk that night to remember various details of what happened between him and Carolyn. The prosecutors could easily take advantage of this and frame him as the killer. Owing to this, she tells Raymond that it would not be a good idea to have Rusty in the witness chair. Raymond, too, is not surprised by this, but it seems likely he will have to eventually consider the option of presenting Rusty as a witness in court.
